This page sets out our standard terms and conditions of business and your statutory rights under The Consumer Protection (Distance Selling) Regulations of 2000.

The use of this website constitutes your acceptance of the below terms and conditions.

Our Deed Poll guarantee

If your Deed Poll carrying our official seal is not accepted as documentary evidence of your change of name by any government department, company or organisation within the United Kingdom, we will issue you with a full refund. We will only give you a refund once you have provided us with the details of the organisation concerned so that we can ascertain their reason for refusing your Deed Poll as documentary evidence of your change of name.

Exceptions to our Deed Poll guarantee

  • If you are a foreign national residing in the United Kingdom.
  • If your Deed Poll has not been correctly executed (signed, dated and witnessed).
  • If your child’s Deed Poll is rejected because the record holders parental consent requirements have not been met.
  • If a record holder requires further documentary evidence that your name has changed for “all purposes”. For example, some financial organisations and the General Medical Council will require you to produce your passport showing your new name before they will amend their records. The UK Passport Service may also require you to prove to them that you are using your new name for all purposes. This can be achieved by showing them documents such as your bank statements and utility bills in your new name.
  • If you were told before your application was processed that we would not be able to offer our guarantee to you due to your individual circumstances.

A Deed Poll cannot be used to have your birth or marriage certificates changed. Similarly, you can not have your past educational certificates changed because they are considered “matter of fact” in that they were correct at the time they were issued.

If we make a mistake on your Deed Poll

In the event that we make a mistake on your Deed Poll (your name(s), address or any other typographical error), we will send you a corrected Deed Poll on the same day as we are notified of the error. There is no fee for this service.

If you make a mistake during the application process

We prepare your Deed Poll document with the information you provide to us during the application process. Therefore, if you make a mistake on the application form and do not amend it, the incorrect information may appear on your Deed Poll. If this is the situation you find your self in, please call our helpline on 0800 781 6359 and we will arrange for a replacement Deed Poll to be sent out to you within four working days. The fee payable for this service is £10. Please note, this service is only available to clients who have made typographical errors (such as the wrong spelling of a name or providing an incorrect post code) and not to clients that have changed their mind about the new name they wish to have.

Our right to refuse your application

We reserve the right to refuse an application that includes a name which we deem to be offensive, blasphemous, racist or in any other way unsuitable. Applications that are considered to be unsuitable by our processing staff will be referred to our Chief Executive who will take the decision as to whether or not we will process the application. In the event that your application is rejected, you will be notified of the situation and we will make arrangements to refund you in full.

Your right to cancel a pending application

Our refund policy is provided in accordance with The Consumer Protection (Distance Selling) Regulations 2000 (“The Distance Selling Regulations”).

The Distance Selling Regulations allow you to cancel your application within seven working days of submitting your application. However, because we prepare your Deed Poll before the end of the seven day cancellation period, your right to cancel is restricted to the period of time from when you submit your Deed Poll application to the time when we begin to prepare your documentation. This is in accordance with section 13.1.a of The Distance Selling Regulations.

By submitting an application for a Deed Poll you are agreeing to waive your seven day cancellation right under The Distance Selling Regulations. If you wish to cancel a pending application, please call our freephone helpline number on 0800 781 6359 as soon as possible after making the decision to cancel so that you can receive a full refund.
